Details of the Central Intelligence Agency’s (CIA) torture program have been unlawfully kept from public view, according to a complaint filed with the National Archives. listed in a complaint (pdf) five areas of concern that have been classified or redacted from the version of the Senate’s torture report executive summary, released in December 2014.

“Secrecy regarding ‘black sites’ and torture has played a major role in ensuring that no CIA personnel could be prosecuted for torture, war crimes, destruction of evidence, or other relevant federal crimes. It has ensured that civil courts were closed to victims of torture, indefinitely delayed trials of the accused perpetrators of the September 11 attacks, and put the United States in breach of its obligations under the Convention Against Torture,” according to the complaint, signed by OpenTheGovernment national security fellow Katherine Hawkins.

Carly Fiorina defends Bush-era torture tactics

US Republican presidential candidate Carly Fiorina has defended the torture and spying tactics that were used by the administration of former President George W. Bush during the so-called war on terror.

Fiorina vigorously defended on Sunday the CIA’s waterboarding technique as a policy that helped “keep our nation safe” in the aftermath of the September, 11, 2001 attacks.

“I believe that all of the evidence is very clear — that waterboarding was used in a very small handful of cases [and] was supervised by medical personnel in every one of those cases,” Fiorina told Yahoo News.

Soldier who attacked Afghan police commander for keeping child sex slave is SACKED

Sergeant 1st Class Charles Martland, from Massachusetts, has been ordered to leave the US army by November 1 and has now been refused leave to appeal.

Nigerian Troops Free Hundreds of Women, Children, Arrest Boko Haram Leader

Guantánamo force-feeding videos released to US court in redacted form

The US government has provided a court with redacted versions of eight videotapes showing forced feeding at Guantánamo Bay that detainees describe as torture.

Images on the tapes depict medical and security teams at Guantánamo restraining and feeding detainee Abu Wa’el Dhiab against his will. Dhiab has since been released.

Lawyers for Dhiab and news organizations including the Guardian are attempting to get the videotapes released. If they succeed, the version of the tapes the Department of Justice (DoJ) has turned over is likely to be what the public will see.

Although the DoJ continues to oppose public release of all 32 force-feeding videos, Dhiab’s attorneys said the new provision of the tapes – from which identifying information about Guantánamo personnel has been removed – indicates that national security would not be harmed by their disclosure.

The situation is expected to last through Oct. 1 as a result of military exercises in the area.

But similar military exercises in the past have caused no interference with civilian ADS-B or TCAS, and AOPA is asking the FAA to explain both why the notam was issued so late and what has changed to raise these new concerns.

When the U.S. Department of Defense published a new Law of War Manual (LOW) this past summer, editorialists at the New York Times sat up and took notice. Their concern was that the manual stated that journalists could be deemed “unprivileged belligerents.” The editorial explained that as a legal term “that applies to fighters that are afforded fewer protections than the declared combatants in a war.” In fact, it is far more insidious than that innocuous description.

Here is the manual’s definition: “‘Unlawful combatants’ or ‘unprivileged belligerents’ are persons who, by engaging in hostilities, have incurred one or more of the corresponding liabilities of combatant status (e.g., being made the object of attack and subject to detention), but who are not entitled to any of the distinct privileges of combatant status (e.g., combatant immunity and POW status).”

Obama administration suppresses account of CIA torture

The US government has declared that the first-person account by Guantanamo detainee Abu Zubaydah of how he was tortured in a CIA prison is a classified document. In other words, the criminals who ordered the torture have stamped “TOP SECRET” on the eyewitness testimony of one of their victims.

The legal action involves an effort to make public the notes taken by defense lawyers for Abu Zubaydah, a US prisoner since 2002, held at Guantanamo Bay for the past nine years. The alleged al Qaeda member was waterboarded 83 times in one month and lost an eye under torture at a CIA secret prison.

“We submitted 116 pages in 10 separate submissions,” Joe Margulies, lead attorney for Zubaydah, told Reuters. “The government declared all of it classified.”

The Israeli regime has once again detained nuclear whistle-blower Mordechai Vanunu, claiming that he violated the terms of his release from prison by taking part in a recent interview with a local TV station.

Craig Murray: I Can Reveal the Legal Advice on Drone Strikes, and How the Establishment Works

David Bethlehem had developed, in his work for Israel, an extremist doctrine of the right of States to use pre-emptive self-defence – a doctrine which would not be accepted by the vast majority of public international lawyers. He clinched his appointment by Blair as the FCO chief legal adviser by presenting a memorandum to the House of Commons Foreign Affairs Committee in 2004 outlining this doctrine, and thus de facto defending the attack on Iraq and the Bush/Blair doctrine.

A key sentence of David Bethlehem’s memorandum is this

“It must be right that states are able to act in self-defence in circumstances where there is evidence of further imminent attacks by terrorist groups, even if there is no specific evidence of where such an attack will take place or of the precise nature of the attack.”

There is a fundamental flaw in this argument. How can you be certain that an attack in “imminent”, if you are not certain where or what it is? Even if we can wildly imagine a scenario where the government know of an “imminent” attack, but not where or what it is, how could killing someone in Syria stop the attack in the UK? If a team were active, armed and in course of operation in the UK – which is needed for “imminent” – how would killing an individual in Syria prevent them from going through with it? It simply does not add up as a practical scenario.

Glenn Greenwald Destroys NYT Myth That US Abides by Cluster Bomb Treaty

American journalist Glenn Greenwald has systematically picked apart and refuted an article published Thursday by the New York Times, which claimed that the United States has abided by the provisions of the international Convention on Cluster Munitions.

The Times article by Rick Gladstone appeared on the tails of the annual report from advocacy group Cluster Munition Coalition, which found that cluster bombs have been used in Syria, Libya, Yemen, Ukraine and Sudan this year.

Gladstone wrote that while the United States has not ratified the treaty, it has abided by its provisions. That’s a flat out lie, according to Greenwald, who provided a detailed and specific account of their use.

Political crisis deepens over delays to UK Iraq War inquiry report

The chairman of the inquiry into the 2003 Iraq War, Sir John Chilcot, was forced to make a statement last week to justify a further delay to the publication of his report.

The inquiry was authorised by Gordon Brown’s Labour government over six years ago and was expected to last a year, with its findings published in the summer of 2011.
