Congress continues treason: votes 356-65 to levy more unlawful war against US soldiers in Afghanistan

My headline is legally accurate, and the side of history you want to be on when America finally recognizes our government and corporate media’s fascism.

The definitions of political terms, relevant laws, and facts are simple; the problem is American’s cognitive dissonance to recognize the “Big Lie” at home rather than in a history book of some other place in some past time.

This article, after the following four paragraphs of context, will explain these simple high school-level definitions of political terms of treason and fascism, relevant laws of war, and relevant facts of war with Afghanistan. I’ll conclude with ~5-minute video clips of Dennis Kucinich and Ron Paul’s House floor statements on the Resolution to end the war in Afghanistan, and a 5-minute clip of news coverage.

The information is so simple, in fact, all of you who passed basic classes in US government and history already understand the information and would deride someone as irresponsible in their citizenry if this fundamental level of competence were somehow confusing.

But because we have the fascist, treasonous government/corporate media that we witness, I write and invite your full self-expression to cause a critical mass of public and political recognition of where we truly are, and the powerful and available future where we want to be. The revolutionary result of realizing the American Dream of unalienable rights, and justice under laws that promote cooperation, dignity, and freedom can be ours if, and only if, we create the breakthrough from our sedated condition.

We can really use your help in whatever way you feel strongest in your unique, powerful and beautiful self-expressions. And again, you authentically want to be on the right side of history when millions of lives and trillions of dollars are at stake; perhaps even the need to prevent the awful plan of a third world war from these “Big Liars.”

The House of Representatives voted on March 10 by 356 to 65 to continue the US invasion, occupation, and war in Afghanistan. You might wish to see how your member of Congress voted in consideration of voting for a non-treasonous candidate and probably requiring going outside the Left and Right arms of America’s one fascist, imperialist political body.

Definitions of political terms of treason and fascism: I’ve written articles with greater detail for treason and fascism, but putting them together in summary may be helpful.

Treason: Causing unlawful war upon the US is an attack upon our nation, consistent with US Constitution Article III Section 3:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.

Causing war against the US is so egregious, it’s the only crime the Founders defined in the Constitution. An unlawful war is the supreme act of betrayal against our military, and a violent overthrow of the US government as we know it by our Constitution. It replaces American limited government under law with unchecked fascism.

The heart of this charge of treason is whether war in Afghanistan is obviously unlawful or open to a lawful interpretation. Understanding the rules of war quickly get to the heart of this crucial issue. If it is the US government itself causing the war through known lies and/or clearly unlawful acts, then it is the US government levying war against our own military.

Fascism: The definition of “fascism” has some academic variance, but is essentially collusion among corporatocracy, authoritarian government, and controlled media and education. This “leadership” is only possible with a nationalistic public accepting policies of war, empire, and limited civil and political rights.

“Constitutional republic” is a political philosophy of limited government, separated powers with checks and balances to ensure the federal government’s power stays limited within the Constitution, protected civil liberties, and elected representatives responsible to the people who retain the most political power. In the US we also embrace inalienable rights of the Declaration of Independence, and creative independence to cooperatively compete for our nation’s best ideas to move forward and be rewarded.

The following 8 paragraphs show American fascism in some detail from my article on that topic. What is the evidence for American fascism in the present?

The US brazenly violates our laws of war, both demanded by the Constitution and the UN Charter, with open invasion of Afghanistan in abject violation of UN Security Council Resolution 1373 and their government’s agreement to help extradite Osama bin Laden upon US presentment of evidence that he was involved in any crime of UN and/or international law. The US refused both the Afghan standard legal requirement of extradition and the UN resolution for cooperation under law and attacked. The new administration of Obama does not acknowledge this illegal history, but expands the invasion and attacks Pakistan. This policy is fascist, not limited by US law.

The US openly lied about reasons to justify an attack upon Iraq, destroying any semblance of argument of “self-defense.” The Obama administration won’t acknowledge the disclosed history from our own House and Senate investigations, and violates his oath of office to prosecute clear crimes. This policy is authoritarian, fascist, and does not hold equality under just laws. It is an un-American policy by definition.

The US tortured, with Obama refusing to prosecute and giving empty rhetoric to end it. The destruction of civil liberties to enforce authoritarian government is fascist, not American.

The US lies for more war with Iran, rejecting inalienable and legal rights for Iranians. Obama continues this policy of unlawful aggression, including official policy for first-strike nuclear weapons upon conclusion that Iran poses a possible future threat to the US and/or our allies. Political leaders and corporate media ignore the ignoble history of US vicious domination of Iranian government through coup and backed invasion. Fascist policy; un-American.

The US violates numerous treaty law with WMD, and hypocritically asserts our war targets' alleged violations justify US armed attack. This rejection of limited government under the law is a fascist empire on the loose, not a law-abiding neighbor. Added hypocrisy is the psychopathic front of American political leaders as Christians.

American corporatocracy is dominated by Enron-like cartels, headed by banks receiving the transfer of TRILLIONS of our tax dollars to pay-off their gambling debts in exotic derivative markets the federal government regulates only in more empty rhetoric. This socialization of corporate-insiders’ losses is fascist, and fundamentally in opposition of the American ideal of cooperative competition on a level playing field. Obvious financial solutions for the public good are ignored in their corporate and not public policy commitment.

While our government's official line is respect for Islam, their wars betray this analysis. If extremists were the small minority, why not peacefully cooperate to marginalize and arrest those in violation of just laws? Muslims as a group are often demonized in US media, and often the entire group is branded as terrorists. For example, consider this segment from the radio talk show of Michael Savage.

The corporate media will not present such disturbing facts and analysis. Their outright lies of commission and omission are prima facie evidence of a controlled media, supported by revealed documentation from whistle-blowers. American freedom of the press is left to independent websites and those few media outlets who tolerate reporting such as you read now.

Relevant laws of war: The UN Charter is a Treaty in Force; an active US treaty. The only part of the UN that’s binding on nations is the crystal-clear restriction on a nation’s use of war. Article VI of the US Constitution declares treaties as having equal power with Constitutional law and laws from Congress. This is also known as the Supremacy Clause.

What the US president and 2/3 of the Senate have agreed to in a treaty is the law of the US until such time as the US rescinds that treaty obligation. The UN Charter is therefore the law of the US with its clear restrictions of using war as a foreign policy option.

The spirit of the UN/US war laws are expressed in the preamble and purpose of the UN:

The preamble of the United Nations includes to “save succeeding generations from the scourge of war… to establish conditions under which justice and respect for the obligations arising from treaties and other sources of international law can be maintained, and… to ensure, by the acceptance of principles and the institution of methods, that armed force shall not be used…”

The UN purpose includes: "To maintain international peace and security, and to that end: to take effective collective measures for the prevention and removal of threats to the peace, and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace..."

The letter of the law that the US invoked is self-defense under Article 51 in its legal justification for war with Afghanistan:

“Article 51: Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security.”

To understand Article 51, we need to define some terms within it. The International Court of Justice (ICJ) is the judicial branch of the UN. Their definition of “armed attack” is by a nation’s government. Because the leadership of the CIA and FBI both reported that they had no evidence that the Afghan government had any role in the 9/11 terrorism, the US is unable to claim Article 51 protection for military action in Afghanistan. The legal classification of what happened on 9/11 is an act of terrorism, not an armed attack. In addition, American Daniel Webster helped create the legal definition of national self-defense in the Caroline Affair as "necessity of that self-defence is instant, overwhelming, and leaving no choice of means, and no moment for deliberation." The US attack on Afghanistan came nearly a month after the 9/11 terrorism. Article 51 only allows self-defense until the Security Council takes action; which they did in two Resolutions (1368 and 1373) claiming jurisdiction in the matter and resolving international cooperation under the law for discovery, arrest, and lawful prosecution of the perpetrators.

In conclusion of the US laws for war, unless a nation can justify its military use as self-defense from armed attack from a nation’s government that is "instant, overwhelming, and leaving no choice of means, and no moment for deliberation," all other acts of war are unlawful. The legal definition of “self-defense” ends when the attack terminates. In general legal definition, no party is allowed use of force under the justification of “self-defense” if the law can be applied for redress and remedy.

Relevant facts of war with Afghanistan: The UN Security Council responded immediately after the 9/11 acts of terror with two resolutions to take jurisdiction for use of force and respond with a course of action consistent with its purpose. The US attack of Afghanistan on October 7, 2001 was therefore a deliberate act of unlawful war, not defense that was "instant, overwhelming, and leaving no choice of means, and no moment for deliberation." The burden of proof the US would have to provide is imminent threat of another attack in order to justify self-defense. US Ambassador to the UN, John Negroponte, in his letter to the UN Security Council invoking Article 51 for the attack upon Afghanistan mentions only “ongoing threat;” which does not satisfy this burden of proof.

Article 51 requires self-defensive war coming from an attack by a nation’s government, which the CIA and FBI refute in the case of the Afghan government with the terrorism on 9/11. Self-defense ends when the attack ends. The US war began four weeks after 9/11 ended; making the US war one of choice and not defense. Article 51 ends self-defense claims when the UN Security Council acts. Resolution 1373 provides clear language of international cooperation and justice under the law, with no authorization of force. This evidence doesn’t require the light of the UN Charter’s spirit of its laws, but I’ll add it: humanity rejected war as a policy option and requires nations to cooperate for justice under that law. The US has instead embraced and still embraces war with its outcomes of death, misery, poverty, and fear expressly against the wishes of humanity and the majority of Americans. These acts are clearly unlawful and should be refused and stopped by all men and women in military, government and law enforcement.

Because it is the US government’s choice to levy this unlawful war, it is the US government who is directly responsible for the subsequent attacks upon our soldiers. Because the US government has unlawfully invaded, it is they who have caused attack upon US soldiers; this is the definition of treason. This is the legal fact of the US armed attack against Afghanistan despite later UN authorization for transition support that is going on 9 years, and doubtful whether elections in Afghanistan to ongoingly authorize US presence have been the free choice of the Afghan public outside of US manipulation.

Conclusion: Following is my usual admonition for action:

It's time.

It’s time for our men and women in government and military to choose: either stand with the US Constitution you’ve sworn to support and defend against all enemies, foreign and DOMESTIC, or remain complicit in ongoing Wars of Aggression, mass murder of our soldiers and our fellow humans in other lands and throwing trillions of our tax dollars to do so, pushing the world ever-closer to an apparently planned and desired nuclear Third World War (and here), and guilty of what Dr. Martin Luther King called “Silence is Betrayal” before the US government assassinated him according to the only trial conducted for his murder.

It’s time for our men and women in the military and government to refuse all orders associated with our unlawful wars and preparation for unlawful war with Iran over one gram of medical isotope worth $75,000 in 20% enriched nuclear fuel. It is hard to imagine a more ridiculous case for war.

It’s time for our men and women in the military and government to refuse all orders associated with our unlawful wars and preparation for unlawful war with Iran and stand with the American public who declare in a ratio of 9 to 1 that our government no longer represents them under the US Constitution.

It’s time: exercise your 1st Amendment right to freedom of speech and press, and to petition the Government for a redress of grievances. Please provide this article to all Americans if you find it helpful to stop current and future unlawful wars.

Over 5,000 US soldiers have been killed so far as pawns of the civilian and military brass tyrants. Multiples more have been crippled physically and emotionally. There is no end in sight to current wars; indeed, the US is expanding them into Pakistan and Yemen and threatening more war with Iran. The dead are comforted by God; their families are devastated by the loss of their loved-ones. The crippled and their families face a range of challenges; many so severe that a total of 6,000 US veterans commit suicide every year. One-third of all US homeless men are veterans.

Our military was duped into these wars with calculated "Big Lies;" our trusting young men and women took an Oath to support and defend the US Constitution that supersedes the Nazi insert of “placing the mission first.” The Claus von Stauffenberg faction of US military and government must act to end this soulless mass-murdering; this loveless series of unlawful wars and unlawful orders, if we want a future we’re proud to build.

This choice is up to our men and women in uniform and government for leadership. I provide:

Explanation of the rules of lawful war omitted from their military training that proves beyond any doubt that current US wars are unlawful.
Analogies that the rules of war are almost exactly like those for an individual’s use of force on the street.
Documentation of lies that were known to be lies as our political “leaders” told them and our war-whore corporate media mimicked to propagandize for war in Iraq.
Proof beyond doubt that the speech of Iranian President Ahmadinejad never threatened Israel.
Documentation that IAEA verifies all of Iran’s nuclear material and has only and always been used for legal and peaceful purposes.
A reminder that you love virtue, American values, and love of your fellow human beings.

And, our men and women in uniform must take action as they see best; as will our men and women in government and citizenry. As a teacher of government and law, I conclude our government leadership is guilty of treason against the American public, and guilty of mass murder against our soldiers.

Choose well; our collective future, and your future, depend upon it.

Policy response: Gandhi and Martin Luther King advocated public understanding of the facts and non-cooperation with evil. I’m among hundreds who advocate:
1.Understand the laws of war (and here). These were legislated after WW2 and are crystal-clear that only self-defense, in a narrow legal meaning, can justify war. The current US wars are not even close to being lawful and are legal treason against the US. Those involved with US military, government, and law enforcement have an oath to protect and defend the US Constitution. To fulfill their oath they must immediately refuse all orders associated with unlawful wars and military-related constant violation of treaties, and arrest those who issue unlawful orders. The Oath of Enlistment to the US Constitution supersedes the fascist insertion of Nazi propaganda to "always place the mission first" of blindly following unlawful orders.
2.Employ the obvious and simple solutions to end our economic controlled demolition and evolve to a civil economy. End poverty through global cooperation to achieve the UN Millennium Goals by developed countries investing 0.7% of their income (not that the UN is serious for their accomplishment, but the goals are what we should invest to produce). Support global security through cooperation, dignity, justice, and freedom. Create a US Department of Peace to help.
3.Communicate. Trust your unique, beautiful, and powerful self-expression to share as you feel appropriate. Understand that while many people are ready to embrace difficult facts, many are not. Anticipate that you will be attacked and prepare your virtuous response in the spirit of competition, just as you do in other fields.
4.Prosecute the war leaders for obvious violation of the letter and spirit of US war laws and constant lies to engage in further wars. Because the crimes are so broad and deep, I recommend Truth and Reconciliation (T&R) to exchange full truth and return of stolen US assets for non-prosecution. This is the most expeditious way to understand and end all unlawful and harmful acts. Those who reject T&R are subject to prosecution.

Local perspective: Part of my professional duties as a teacher of economics and government is to produce competent adult citizenry. This includes realization that our nation’s policies and money are managed at a broad community level, and these issues have tremendous local impact. Of course, we all want human beings to be individually successful and enjoy their unique, beautiful and powerful self-expressions. Concurrently, we recognize our commitment to local success is strongly dependent upon the success of the community, and that government policy and economics are drivers.

Our status in early 21st Century human history is that we suffer from a long history in government and money of human interrelationship well-described as vicious antagonism. Governments frequently use war as a foreign policy, despite its illegality and dependent upon public ignorance, with horrific consequences. Economic policy is still created within a “Robber Baron” paradigm to concentrate money to an elite few families. Two examples:

1. National taxes effect you dearly, especially the tax to pay interest on the national debt. This costs the American public over $400 billion every year. This is $4,000 per year for every $50,000 of income. Do the math to understand your household’s tax burden for a monetary policy invented by banks for banks to create our money supply as debt. Your competence in this area contributes to our collective voice to simply shift monetary policy to easily pay the national debt, enjoy full employment, collectively save us over a trillion dollars every year, and finally realize what our brightest American minds have been advocating for centuries beginning with Benjamin Franklin. This would have unprecedented local benefits, and requires collective power to accomplish.

2. Ending poverty everywhere on our planet would cost just 0.7% of our income and save a million children’s lives every month. This human accomplishment will cause unimaginable joy at our local level.

Working for your best imagined self-expression of virtue may include a unique contribution from the inside of your agency. Public attraction to the stories of Star Wars and the Harry Potter books/movies recognize that our society’s jump to civilized relations for all of us might require support from people within the “dark side” acting as covert agents for building a brighter future. Another option is becoming a whistle-blower; Project Camelot is a popular venue for people in sensitive positions. Ultimately, I recommend a Truth and Reconciliation process to exchange full truth for no prosecution, explained in detail at the link. Please consider the wisdom of your own “Scrooge conversion” to act for the benefit of all humanity rather than your self-proclaimed controlling, manipulating, and loveless “masters.”
