Landmark civil rights legal records deleted from Pacer

Records of landmark US civil rights cases presided over by one of the country's most senior judges have been removed from the internet.

The state-run Public Access to Court Electronic Records (Pacer) service deleted numerous court documents deemed incompatible with a software upgrade.

These included appeals heard by Justice Sonia Sotomayor prior to her appointment to the Supreme Court.

A famous racial discrimination case was among the expunged files.

Florida Police Chief Defends Cops’ Aggressive, Violent and Life-Threatening Reaction Against Men Video Recording them

Boynton Beach Police Chief Jeffrey Katz defended the aggressive reaction of his officers in a Youtube video Tuesday, claiming the men in the car were “escalating” the situation by “recording the interaction,” causing one of the officers to fear for his life when a man “reached out of his window with a black object in his hand,” which was nothing more than a camera phone trying to record the cop’s name tag after he refused to provide it.

That cop slapped the phone out of his hand, then yanked the man out of the car, throwing him facedown on the grass while another cop with his gun drawn comes charging towards the other men, threatening to shoot one of them for who knows what.

“I’ll put a round in your ass so quick,” the cop said, even though none of the men in the car were doing anything more than being assertive about their rights, even if they were doing it in a profane manner, which is protected by the First Amendment.

The fact of the matter is that in America today you are expected to convict yourself. Even your lawyer expects it. The torture is not physical; it is psychological. The system is severely biased against the defendant. Conviction by a jury brings a much heavier sentence than conviction by a deal that the defendant’s attorney negotiates with the prosecutor’s office. All the prosecutor wants is a conviction. Give him his conviction for his record as an effective prosecutor, and you get off lighter.

The injustice lies in the fact that the rule applies to the innocent as well as to the guilty.
The prosecutor and often the judge do not care whether you are innocent or guilty, and your lawyer knows that it does not matter to the outcome.

'Sons of Guns' star booked on rape charges

The founder and owner of Red Jacket Firearms in Baton Rouge was arrested Tuesday evening and charged with the aggravated rape of a 12-year-old child, Casey Rayborn-Hicks, a spokesperson for the East Baton Rouge Sheriff's Office said.

The U.S. Marshal in East Baton Rouge Parish arrested William Hayden around 3 p.m. Tuesday. Hayden had a warrant out for his arrest and was apprehended in Livingston Parish as a fugitive from East Baton Rouge Parish.

Hayden is the star of Discovery's Channel reality TV show "Sons of Guns."

Cambridge Mace's Lane Middle School Teacher on Administrative Leave

He's a man with many names, and the books he has written have raised the concerns of the Dorchester County Board of Education and the Dorchester County Sheriff's Office.

Early last week the school board was alerted that one of its eighth grade language arts teachers at Mace's Lane Middle School had several aliases. Police said that under those names, he wrote two fictional books about the largest school shooting in the country's history set in the future.

Rotherham child abuse scandal: Labour urges police commissioner to resign

The Labour party has called for the resignation of South Yorkshire's police and crime commissioner, Shaun Wright, in the wake of the child sex abuse scandal in Rotherham.

Wright was a Labour cabinet member for children and young people's services at Rotherham council from 2005 to 2010 when he received three reports about widespread abuse but failed to act, according to Prof Alexis Jay's damning report on the sexual exploitation of 1,400 children over 16 years in the South Yorkshire town.

Speaking publicly for the first time since the report was published, Wright insisted on Wednesday that he had acted properly, and rejected calls for him to go.

Wright told the BBC: "The scale of the problem has come as a surprise to me." He said he was not aware of the "industrial scale" of the abuse.

Video shows police shot Ohio man ‘on sight’ as he leaned on toy gun in Walmart, attorney says

John Crawford III died Aug. 5 after police were called to Walmart in Beavercreek, near Dayton, by another shopper who reported a man carrying what appeared to be an AR-15 rifle.

The 22-year-old Crawford was instead carrying an unpackaged MK-177 (.177 caliber) BB/pellet rifle he picked up in the store’s toy department.

Police claim Crawford ignored their commands to drop the weapon, and the former Marine who called in the report and witnessed the shooting said Crawford “looked like he was going to go violently.” But attorney Michael Wright said surveillance video from the incident, which Ohio’s attorney general allowed him to watch with Crawford’s family, contradicted those accounts.
“John was doing nothing wrong in Walmart, nothing more, nothing less than shopping,” Wright said.

Virginia ex-Gov. Bob McDonnell (R) revealed during testimony last week that he moved out of his family home and in with his parish priest the week before his federal corruption trial began.

McDonnell explained on the stand that living separately from his wife Maureen would make it easier for him to prepare for trial each day and described their marriage as "on hold. " The priest he is staying with or the time being, Rev. Wayne Ball of St. Patrick's Catholic Church in Richmond, Va., is a family friend who officiated his daughter Cailin's wedding.

Ball also pleaded guilty to a misdemeanor sex charge in late 2002.

Iranian sail boat defended itself against U.S. Coast Guard

As preposterous as it may sound, the U.S. coast guard boards boats everywhere in the world, not just along the American coast, and if things are not perfect, they detain everyone on the boat and burn it, even if it is a multi million dollar yacht. Knowing this policy, an Iranian fishing boat that was operating off the coast of Iran refused to allow boarding by the U.S. coast guard. The Coast Guard fired on this boat, but according to the Washington Post, left it floating with all aboard. At the end of this report is a link to a Washington Post article that downplays the Coast Guard's hostile role in international waters, and the attitude expressed in the Washington Post article says a LOT.

A Georgia man died after police shocked him with a Taser as many as 13 times because he said he was too tired to walk due to a foot chase, his attorney said this week.

At a press conference on Tuesday, attorney Chris Stewart said that police records showed that East Point officers had discharged their Tasers 13 times to make Gregory Towns, who was handcuffed, get up and walk.

The background of a key negotiator in the battle over a Senate report on the CIA’s use of interrogation techniques widely denounced as torture has sparked concerns about the Obama administration’s objectivity in handling the study’s public release.

Robert Litt, the general counsel for the Office of the Director of National Intelligence, is a former defense lawyer who represented several CIA officials in matters relating to the agency’s detention and interrogation program. Now he’s in a key position to determine what parts of the Senate Intelligence Committee’s 6,300-page report will be made public.

Litt’s involvement doesn’t appear to be an ethics issue, at least by the legal definition. But experts say that while it may be acceptable on paper, his involvement in the review should have been a red flag.

Obama Talks Up Long Iraq War, Congressional Role Unclear

President Obama has made his latest in a long line of comments on the new Iraq War today, declaring “rooting out a cancer like ISIS won’t be easy and it won’t be quick.”

As usual, the focus was on a long war with a growing collection of missions attached, today’s being revenge for the execution of journalist James Foley. As the signs of an open-ended war in Iraq mount, the question of Congressional involvement remains unresolved.

The administration has downplayed the idea of even needing Congressional authorization for wars, saying they can launch them unilaterally and will “keep Congress informed” of the decisions they make. Where Congress as a whole would stand on such a vote is unclear, though many seem reluctant to hold the vote at all, preferring to avoid scrutiny of their position on the war come election time.

US Surveillance Flights A Step Toward Expanding War Into Syria

Officials confirmed the move toward surveillance flights over ISIS targets in Syria, leaving somewhat open the question of when the US is going to start launching airstrikes against targets inside Syria, expanding the Iraq War across the border.

Yet it’s not really a question of if, but when, as the surveillance flights are clearly the first step toward such attacks. The primary question is how to start launching such attacks without Syrian coordination, since officials want to avoid the appearance of cooperating with Syria.

The questions abound about expanding the war into Syria and are mostly unanswered, with Gen. Dempsey pushing the attacks, and the US already giving targeting intel to Syria’s government for the ISIS war.

Russia’s Gazprom Neft to Sell Oil for Rubles, Yuan

The Russian oil company Gazprom Neft has agreed to export 80,000 tons of oil from Novoportovskoye field in the Arctic; it will accept payment in rubles, and will also deliver oil via the Eastern Siberia-Pacific Ocean pipeline (ESPO), accepting payment in Chinese yuan for the transfers, the Russian business daily Kommersant reported Wednesday.

The Russian government and several of the country’s largest exporters have widely discussed the possibility of accepting payments in rubles for oil exports.

Last week, Russia began to ship oil from the Novoportovskoye field to Europe by sea. Two oil tankers are expected to arrive in Europe in September. According to Kommersant, the payment for these shipments will be received in rubles.

Gazprom Neft will not only accept payments in rubles; subsequent transfers via the ESPO may be paid for in yuan, the newspaper reported.

According to the newspaper, the change in currency was made because of the Western sanctions against Russia.

Physical Silver Inventory Declined By 24%

As I mentioned in a earlier article, the Comex is more of a paper trading exchange in which the majority of contracts are settled in cash. However, the opposite is the case with the Shanghai Futures Exchange as the majority of contracts are settled with physical metal.

At the beginning of August, there were 148 metric tons of silver on warrant at the Shanghai Futures Exchange. In just three weeks, 29% of the total inventory was removed. The majority of this decline took place last week when 22 metric tons were withdrawn on Friday alone.

Also, we can see that since the beginning of July, 131 metric tons, or 56% of total silver stocks were removed from the Shanghai Futures Exchange. At this trend, it would only take a few more months to totally wipe out the remaining inventory.

Russia Not Declaring All Gold Reserves To IMF?

Russia now has the world’s 6th largest gold reserves, officially higher than both Switzerland’s 1,040 tonnes and China’s 1054.1 tonnes. As a comparison, in the second quarter of 2009, Russia only had 550 tonnes of gold in its official reserves meaning that their reserves have nearly doubled in just over 5 years.

The ongoing accumulation of official gold by Russia appears to be part of a reserve diversification strategy. Gold is held by central banks as one of their reserve assets alongside foreign exchange assets including US Dollars and Euros, and also IMF Special Drawing Rights (SDRs).

Some Russian analysts point to the threat of continued western sanctions on Russia as a renewed catalyst for the Russian central bank diversifying out of dollars and euros by increasing its gold reserves. Gold now accounts for over 12% of Russian official reserves and could reach 15% by year end if the current trend continues.

Western sanctions push Russia, China closer; hurt dollar

y forcing Russia to conduct more business in the yuan and other Asian currencies, the U.S. may be speeding up the end of the petrodollar and giving China more prominence on the world stage.

As the West tightens financial sanctions against Russia over the conflict in Ukraine, Russian businesses are reducing their exposure to the dollar to minimize the damage from still tougher punishments. Many of these businesses have turned to the Hong Kong dollar as an alternative to the greenback.

Russian mobile phone carrier MegaFon said it will convert 40% of its dollar- and euro-denominated cash reserves into Hong Kong dollars.

Major nonferrous metal producer Norilsk Nickel has also decided to shift its U.S. dollar funds into the Hong Kong dollar.

Argentina defaulted for the second time in 12 years after hopes for a midnight deal with holdout creditors were dashed, setting up stock and bond prices for declines on Thursday and raising chances a recession could worsen this year.

After a long legal battle with hedge funds that rejected Argentina’s debt restructuring following its 2002 default, Latin America’s third-biggest economy failed to strike a deal in time to meet a midnight deadline for a coupon payment on exchange bonds.

Even a short default will raise companies’ borrowing costs, pile more pressure on the peso, drain dwindling foreign reserves and fuel one of the world’s highest inflation rates.

However, Argentina is not the only country that has struggled to pay its debt recently. There are 10 other countries currently on Moody’s lists with a rating of Caa1 or worse, meaning they are at risk of default.

Finally, a little-known aspect of the crisis in Ukraine is receiving some international attention. On July 28, the California-based Oakland Institute released a report revealing that the World Bank and the International Monetary Fund (IMF), under terms of their $17 billion loan to Ukraine, would open that country to genetically-modified (GM) crops and genetically-modified organisms (GMOs) in agriculture. The report is entitled “Walking on the West Side: the World Bank and the IMF in the Ukraine Conflict.” [1]

In late 2013, the then president of Ukraine, Viktor Yanukovych, rejected a European Union association agreement tied to the $17 billion IMF loan, whose terms are only now being revealed. Instead, Yanukovych chose a Russian aid package worth $15 billion plus a discount on Russian natural gas. His decision was a major factor in the ensuing deadly protests that led to his ouster from office in February 2014 and the ongoing crisis.

Russia can’t set ceasefire conditions in Ukraine’s internal conflict – Putin

Russian and Ukrainian leaders have concluded their first official face-to-face meeting in Minsk during which they discussed Ukraine's Association Agreement with EU and the crisis and humanitarian disaster in the east of the country.

Russia will do everything to facilitate a peace process in Ukraine, President Putin told the press following the 2-hour talks, which he described as “positive.”

However, Russia did not and had never set forth conditions for settling Ukraine’s internal conflict, Putin added, so a ceasefire agreement was not discussed during the talks in the absence of peace suggestions from Ukrainian leadership.

F-15 military jet crashes in Virginia

An F-15 military jet crashed in western Virginia early Wednesday, according to local media reports.

In Deerfield, Virginia, multiple news outlets have reported already that an aircraft crashed shortly after 9:00 a.m. local time in a wooded part of the region around 180 miles west of Washington, DC. By 10:30, the news site had confirmed that a spokesperson for the National Travel Safety Board identified the aircraft as a military jet.

Officials with the August County Sheriff’s Office told a local ABC News affiliate that a loud boom had been heard in the mountainous part of Deerfield at around 9:15 a.m., and that witnesses reported black smoke emerging from the scene. The News Leader also reported that Virginia State Police had been notified roughly at the same time of a plane crash, and that the debris was likely that of an F-15 jet.

The university installed a surveillance camera to watch Sarah's door, but without telling her, and promptly caught Sarah committing the vandalism herself!

Every time Israel commits a war crime, the very first thing they do is replay the tired old WW2, Hitler, Holocaust, anti-Semitic card to try to regain the world's sympathy. FDA admits not knowing about existence of many food chemicals, let alone their safety

The explosive introduction of new food additives, in addition to an easing of some federal oversight requirements, has allowed manufacturers to dodge scrutiny from the Food and Drug Administration, the agency responsible for ensuring the safety of chemicals that are flowing into the food supply.

And, as reported by The Washington Post, in hundreds of cases the FDA is not even aware of the existence of new additives, which can include chemical preservatives, thickening agents and flavorings, interviews and records have shown.

Smith and his students use seismographs to map the magma pool underneath Yellowstone’s volcano, and satellites to determine how much the land swells, or bulges. They found that the magma is much larger than they originally believed.

As he sits on his porch in Moose, underneath the towering beauty of the Grand Tetons, Smith explains just how big the magma body is.

“Before we thought it was 20 kilometers long. We discovered just this year that it’s two and a half times bigger. Two point five times. It’s 90 kilometers long.”
