Alberta Moves to Strike Down Anti-fracking Activist's Lawsuit

An Alberta government lawyer argued in court this week that Jessica Ernst's lawsuit on hydraulic fracturing and groundwater contamination should be struck down on the grounds that it would open a floodgate of litigation against the province.

"There could be millions or billions of dollars worth of damages," argued Crown counsel Neil Boyle.

Seven years ago, oil patch consultant Ernst sued Alberta Environment, the Energy Resources Conservation Board and Encana, one of Canada's largest shale gas drillers, over the contamination of her well water and the failure of government authorities to properly investigate the contamination.

Former US professional boxer Rubin “Hurricane” Carter, who spent 19 years in prison for murder and then was released after it was determined he did not get a fair trial, died today at the age of 76, according to reports in the Canadian media.

Carter, considered a folk hero by many and immortalised in film and song, had been battling prostate cancer for months, according to reports by the Toronto Globe and Mail and the CBC. He died in Toronto, where he had been living since he was released from prison in 1985, according to the reports.

Slavyansk mayor asks Russia to send peacekeepers in wake of deadly night attack

Head of the self-defense units of Ukraine's eastern town of Slavyansk, Vladimir Ponomaryov, who was appointed Slavyansk mayor by the town's residents, has asked Russia to send peacekeepers to eastern Ukraine to protect civilians from National Guard and Right Sector militants.

"They kill our people. They don't talk to us but just kill," Ponomaryov said at an emergency press conference in the wake of last night's armed clashes on the outskirts of Slavyansk.

"The town has actually been besieged by the Right Sector," he said.

Oregon Cows Are Tough - Black Bear Loses

A couple of evenings ago, an Eastern Oregon rancher went out to check his beef herd. He saw a very strange sight -- and was able to photograph an unusual battle between a black bear and some brave cows. The bear began to attack a cow and then the herd came to her aid. One cow in particular got especially aggressive and head-butted the bear right off its feet. Then, two cows sandwiched the bear between their heads. After that, the bear decided to flee and limped back into the woods.

Oath Keepers from Across the Country Pour into Nevada

Despite the fact that Senator Harry Reid has called these Patriots “domestic terrorists”, the militia members and Oath Keepers there to support Cliven Bundy have peacefully assembled in Bunkerville, Nevada for more than a week to protect the rancher from armed federal land grabbers. Although the BLM has allegedly backed off citing “safety concerns,” the surly Senator Reid (who has incidentally been busted with his hand in the $5 million solar power cookie jar) commented, “Well, it’s not over. We can’t have an American people that violate the law and then just walk away from it. So it’s not over.”

Because of statements like Reid’s, a request was made by Oath Keeper’s founder Stewart Rhodes for reinforcements.

To recap...

The Bundy Family purchased all of that land in 1877, only to have it seized by the government in the 1930s. This violated Article 1, Section 8, Clause 17 of the Constitution, known as the Enclave Clause, which limits the Federal Government to owning land ONLY for Federal Buildings and military installations, NOT seizing millions of acres of private and public lands to be sold to corporations or pledged as collateral on out-of-control government borrowing.

Then there is the Homestead law, which says ownership of the land belongs to those who have lived on the land and developed it, which the Bundys have done in an unbroken chain since 1887.

The BLM does not have legal jurisdiction as the land in question is actually under state control.

The reason behind the land grab is complex. The US Government wants to sell fracking leases on that land but without sharing the lease payments with the lands’ rightful owners. One of Harry Reid’s major (illegal) donors is named Harry Whittemore, who has plans to commercially develop that land once the BLM transfers that land from public property to his private use. Harry Reid’s son, Rory, represents a Chinese energy firm that plans to put up a solar power plant in the area. They already acquired $38 million worth of public land for a mere $4.5 million.

The rest of the land, and Obama is about to grab another 10 million acres through Execute Order, is being used to collateralize more government borrowing. This has been the norm since Nixon ended gold convertibility in 1970, and the world realized that the US did not have enough cold to cover all the loans. So Nixon created the Environmental Protection Agency which had little to do with the environment and everything to do with grabbing huge tracts of public (and sometimes private) land and locking it away from the American people to pledge (along with the mineral rights) as collateral for more government borrowing. Almost 1/3 of US public lands, technically the property of We The People, are now locked away and pledged as collateral on US Government debt.

The incident at the Bundy Ranch has brought the issue of government land-grabbing into the spotlight, but the problem is ongoing and widespread, with hundreds of ranchers and farmers being forced from their land over the last several years, often with no compensation for their stolen property.

Inmates at an Alabama prison plan to stage a work stoppage this weekend and hope to spur an escalating strike wave, a leader of the effort told Salon in a Thursday phone call from his jail cell.

“We decided that the only weapon or strategy … that we have is our labor, because that’s the only reason that we’re here,” said Melvin Ray, an inmate at the St. Clair correctional facility and founder of the prison-based group Free Alabama Movement. “They’re incarcerating people for the free labor.” Spokespeople for Alabama Gov. Robert Bentley and his Department of Corrections did not respond to midday inquiries Thursday. Jobs done by inmates include kitchen and laundry work, chemical and license plate production, and furniture-making. In 2011, Alabama’s Department of Agriculture reportedly discussed using inmates to replace immigrants for agricultural work; in 2012, the state Senate passed a bill to let private businesses employ prison labor.

The US's prison industrial complex is a toxic topic most politicians don't want to talk about.

Prison labor is definitely America's slave labor, and any rehabilitation efforts, for most of America's prisons in the 21st century, are few and far between.

The system bets on recidivism to bring people back into the prison system, and private prison corporations which are paid by various states, to warehouse prisoners, are among the worst offenders in their care of prisoners.

In Sweden, they are closing prisons because the focus is completely on rehabilitation; getting prisoners jobs when they leave prisons; and making sure that they reintegrate with their families.

This seems to me to be a far more enlightened approach to prisoner management, and the recidivism rate is very low, compared to that of the US.

IF Sweden can do this, why can't the US? Because the US and State governments are very happy with this slave labor, and don't want to see it end.

I'll go out on a limb here and guess that when Professor Francis Schmidt was summoned to the school's human resources department over a "threatening email" he was probably absolutely baffled.

When Schmidt arrived at the meeting, the human resources director, two college officials, and a security official were awaiting him. Schmidt had been reported by the dean of the school for sending a threatening email.

Now Canonical is pushing out the latest version of its popular Linux distro. Ubuntu 14.04 LTS (code named: Trusty Tahr) is part of its long term support series which means it will receive support and security updates for five years rather than the usual nine months. That's a major deal for companies using either on desktops and servers. But servers and enterprise desktops aren't where the excitement lies. What makes Trusty a huge deal for Canonical is that it finally makes the OS ready to use on touchscreens, high DPI displays and tablets.

Did you know that Family Dollar is closing 370 stores? When I learned of this, I was quite stunned. I knew that retailers that serve the middle class were really struggling right now, but I had no idea that things had gotten so bad for low end stores like Family Dollar. In the post-2008 era, dollar stores had generally been one of the few bright spots in the retail industry. As millions of Americans fell out of the middle class, they were looking to stretch their family budgets as far as possible, and dollar stores helped them do that. It would be great if we could say that the reason why Family Dollar is doing so poorly is because average Americans have more money now and have resumed shopping at retailers that target the middle class, but that is not happening. Rather, as you will see later in this article, things just continue to get even worse for Americans at the low end of the income scale.

When I first joined WRH nearly 4 yrs ago, the few active members here posted no more than 10 articles in a day. That was until this cat joined http://whatreallyhappened.com/users/activistpost

He was good for 30 articles a day and found himself on the info-map nearly overnight as a result of WRH.

A few of us bitched and complained to Mike, myself more, in fact I blogged about it here as I do now.

Now that that this member has found his site equaling the same number of viewers as this 20 yr old site, he has no need it seems.

This type of behavior disturbed me to no ends, the final straw for me was having Rinf and AlexMark join in the last year. They made AP look like a casual contributor in comparison.

I think unknown to Mike these two did battle with each other here, posting each others articles after each other, deleting and re posting the same article to get it to the top ect.

It was real silly, and it just seemed the adults left the room more than a year ago.

General Motors says it will soon file a motion with a federal bankruptcy judge in New York seeking a court order preventing the families of accident victims from suing the company over defective ignition switches that have been tied to fatal crashes.

As part of the 2009 bankruptcy and restructuring of GM the Obama administration inserted a clause holding the reorganized company harmless from lawsuits stemming from before July 2009. Many of the deaths and injuries resulting from the faulty ignition switches installed on several 2003-2007 GM models, which have now been recalled, took place prior to 2009. At the time, GM was facing 2,500 lawsuits of various kinds. Most received pennies on the dollar.

At Chen Qiang’s tilapia farm in Yangjiang city in China’s Guangdong province, which borders Hong Kong, Chen feeds fish partly with feces from hundreds of pigs and geese. That practice is dangerous for American consumers, says Michael Doyle, director of the University of Georgia’s Center for Food Safety.

“The manure the Chinese use to feed fish is frequently contaminated with microbes like salmonella,” says Doyle, who has studied foodborne diseases in China.

On a sweltering, overcast day in August, the smell of excrement is overpowering. After seeing dead fish on the surface, Chen, 45, wades barefoot into his murky pond to open a pipe that adds fresh water from a nearby canal. Exporters buy his fish to sell to U.S. companies.

Yang Shuiquan, chairman of a government-sponsored tilapia aquaculture association in Lianjiang, 200 kilometers from Yangjiang, says he discourages using feces as food because it contaminates water and makes fish more susceptible to diseases. He says a growing number of Guangdong farmers adopt that practice anyway because of fierce competition.

In 2012, the nation’s law enforcement agencies reported that there were 7,164 victims of hate crimes. Of these victims, 13 were victimized in 6 separate multiple-bias incidents.
